Discussion: Making the change suggested by the commenter
is not appropriate because §303.28 defines parent training
and information centers solely by reference to sections 671 and 672 of the Act, which provide the substantive definitions of parent training and information centers and community parent resource centers and identify the responsibilities and activities of these centers. We cannot include in these regulations changes that would alter the statutory requirements for these centers under the Act.
Personally identifiable information (§303.29)
Comment: Some commenters requested clarification of the confidentiality provisions. One commenter requested that the information protected under the Part C confidentiality provisions align with the information that is protected under FERPA.
Discussion: We agree it is important to align the definition of personally identifiable information in these regulations with the definition of that same term in 34 CFR 99.3 under the Family Educational Rights and Privacy Act (FERPA) (in section 444 of the General Education Provisions Act).
