Comment: Several commenters expressed concerns with the
dispute resolution options in §303.430. A few commenters
stated that the options do not fit into the Part C program
because the child’s time in the program is limited. The
commenters stated that the 30-day timeline for the resolution period and the 45-day timeline for the due process hearing in States that choose to adopt Part B due process procedures under section 615 of the Act are too long.
Discussion: Section 303.430 requires each statewide system to include procedures to resolve complaints through mediation, State complaint procedures, and due process procedures. The concerns about the timelines for the resolution period and the due process hearing in States that choose to adopt Part B due process procedures under section 615 of the Act, are more fully addressed in the Analysis of Comments and Changes in response to the
comments received on §303.440.
